TERMS OF SERVICE — FALTA STUDIO

OVERVIEW

Falta Studio (“we”, “us”, “our”) provides branding services, digital assets, templates, mockups, and AI-powered generative tools (including Mina and Matcha credits).

By accessing or purchasing from our store, you agree to these Terms of Service, our Refund Policy, and any applicable License Agreements.

SECTION 1 — NATURE OF PRODUCTS & SERVICES

Our offerings include:

  • Digital products (mockups, templates, assets)
  • AI-generated outputs via Mina
  • AI credits (“Matcha”)
  • Branding and creative services

All products are intangible, digital, and/or creative in nature, and results may vary.

SECTION 2 — DIGITAL PRODUCTS (MOCKUPS, TEMPLATES)

All digital products are:

  • Licensed, not sold
  • Subject to our Digital Assets License Agreement
  • Non-transferable and non-exclusive

You may not:

  • Resell, redistribute, or sublicense original files
  • Create competing templates or products
  • Claim ownership of the assets

Use is strictly governed by your license tier.

SECTION 3 — AI SERVICES (MINA)

Mina is an AI-powered system that generates creative outputs.

You acknowledge that:

  • Outputs are generated algorithmically and may vary
  • Results are not guaranteed to be unique, error-free, or fit for purpose
  • You are responsible for how outputs are used, published, or commercialized

We do not guarantee:

  • Business results
  • Copyright eligibility
  • Legal compliance of generated content

SECTION 4 — AI CREDITS (“MATCHA”)

Matcha credits are prepaid, consumable digital units used to generate content.

  • Credits are consumed upon generation
  • Once used, credits cannot be reversed

Refund Rule (Limited Exception):

  • If fewer than 5 image generations OR 1 video generation have been used, you may request a partial refund of unused credits within 7 days of purchase
  • A processing fee (including Shopify/payment fees) will be deducted
  • After usage exceeds this threshold, all sales are final and non-refundable

We reserve the right to deny refunds in cases of abuse, fraud, or excessive usage patterns.

SECTION 5 — NO REFUNDS (GENERAL RULE)

Due to the digital and irrevocable nature of our products:

  • All sales are final and non-refundable
  • This applies to templates, mockups, and AI credits once used

Refunds are only granted:

  • Under the limited Matcha rule above
  • If required by applicable law

SECTION 6 — EU DIGITAL WAIVER

If you are located in the European Union:

By purchasing digital products or using AI credits, you:

  • Consent to immediate delivery and execution
  • Waive your 14-day withdrawal right once access or usage begins

SECTION 7 — INTELLECTUAL PROPERTY

All content, systems, assets, AI outputs, and materials remain the property of Falta Studio or its licensors.

No ownership is transferred.

You are granted a limited license to use outputs and assets in accordance with:

  • These Terms
  • The Digital Assets License Agreement

SECTION 8 — PROHIBITED USES

You may not:

  • Resell or redistribute our assets or outputs
  • Use our tools to create competing services
  • Use outputs for unlawful, harmful, or misleading purposes
  • Attempt to reverse engineer, scrape, or exploit our systems

We reserve the right to suspend or terminate access at any time.

SECTION 9 — NO GUARANTEE OF RESULTS

We do not guarantee:

  • Business success
  • Revenue, conversions, or growth
  • AI output accuracy or suitability
  • Compatibility with third-party tools

All services are provided “as is”.

SECTION 10 — LIMITATION OF LIABILITY

To the fullest extent permitted by law:

Falta Studio shall not be liable for:

  • Loss of profits, revenue, or data
  • Business interruption
  • Indirect or consequential damages

Our total liability shall not exceed the amount paid for the product or service.

SECTION 11 — TERMINATION

We may suspend or terminate access if:

  • You violate these Terms
  • You misuse our products or services
  • Payment issues occur

Upon termination:

  • Access may be revoked
  • Licenses may be cancelled

SECTION 12 — GOVERNING LAW

These Terms shall be governed by the laws of Dubai, UAE.
